Understanding how police officers/law enforcement officers are supposed to conduct DUI Investigations is imperative to successfully defending against a DUI Charge in Orange County, California or anywhere else for that matter. POLICE PROCEDURE - DUI INVESTIGATIONS

Police conduct DUI Investigations according to a specific protocol or phases, which are as follows:

Phase I—“Vehicle in Motion”

Phase II—“Personal Contact”

Phase III—“Pre-Arrest Screening”

The “Vehicle in Motion Phase” covers the “Driving Cues”, meaning, the driving maneuvers that the officer observed and whether they were consistent with a person who is, or may be, under the influence of alcohol and/or drugs. Put in a more legal sense: "Did the officer have reasonable suspicion to stop and detain the driver in the first place?"

Issues relating to insufficient "Reasonable Suspicion" to stop and detain a driver are usually pursued through Motions to Suppress pursuant to Penal Code Section 1538.5. The most common of the California Vehicle Code Sections used by officers are included in the list below:


The “Personal Contact Phase” consists mainly of the observations of “Objective Symptoms of Intoxication”, such as, but not limited to, the odor of alcohol, (which in and of itself is insufficient on its face), bloodshot/watery eyes and/or red/watery eyes, (which is also in and of itself insufficient on its face), unsteady gait, (which is being unsteady on one’s feet, stumbling, falling down or over, and not being able to maintain one’s balance to name just a few); and slurred speech, which is also insufficient on its face but an observation to be considered in the case as a whole along with the other aforementioned subjective signs of intoxication. This phase also will include the “Pre-Field Sobriety Test Questions” that are administered prior to the DUI Investigation that are answers that can be used against you in a court of law despite the fact that you were never read your Miranda Rights as Miranda Rights do not apply to almost every DUI Investigation. As with everything, there are some limited exceptions.

The third and final stage is the “Pre-Arrest Screening Phase”, which includes "Field Sobriety Testing" and other things the officer observes during the DUI Investigation, which is discussed in more depth in the “Field Sobriety Test” link.

In addition to the investigation evidence, there is also audio and/or video evidence that is often obtained by way of the officer’s “dash-cam”, which records the DUI Investigation. Typically the last piece of Police Evidence is the chemical test evidence, which consists of either a breath or a blood test. In Orange County law enforcement officers use “Roadside Breath Testing” for evidential testing purposes. As such, there is no need to be taken down to the police station to submit to a chemical test. In blood test cases, "Blood Tests" are still typically administered either at the police station or at the jail.
