An emerging area of DUI is the DUI-D, or Driving Under the Influence of Drugs, charge under what was previously Vehicle Code Section 23152(a)-driving under the influence of alcohol and/or drugs; however, in 2014 two new statutes were enacted: Vehicle Code Section 23152(e), driving under the influence of drugs, which includes all prescription medications, and Vehicle Code Section 23152(f), driving under the combined influence of alcohol and drugs.

There are companion statutes to the standard DUI Drug charges when there is an accident or traffic collision involved that causes injury to another person or persons, (commonly referred to as DUI With Injury and/or Great Bodily Injury), which can be found under Vehicle Code Section 23153(e) and Vehicle Code Section 23153(f).

In DUI Drugs cases, the prosecution must prove that the medication was actually causing impairment. The fact that the person took the drug does not mean that the person was actually impaired by the drug.
