OBJECTIVE SIGNS OF INTOXICATION

Related to the issue of Anonymous Tipsters, or 911 Callers Reporting DUI Drivers, is the issue of a private citizens reporting individuals who were not observed driving but were acting like an intoxicated person who then attempted to drive. In Johanson v. DMV (1995) 36 Cal.App.4th 1209, the court found sufficient probable cause from a private citizen’s observations that the defendant was “actin’ like a little child....” The court went on to describe the facts:

At approximately 2 a.m., [the defendant] attempted to drive out of the garage the wrong way. When asked to reverse his course, he became belligerent and refused to comply, eventually breaking the wooden gate twice and striking the security guard with his car. Additionally, [the cop’s] observations of [the defendant’s] bloodshot eyes, slurred speech, and unsteady gait not only confirm [the citizen’s] opinion that [the defendant] was drunk but are the kind of indications [the citizen] would have easily observed.


It would appear that no one is safe from having an "officious intermeddler", or a person who voluntarily, and without a request to do so, or even a pre-existing legal duty to do so, interjects himself or herself into the affairs of another. The California State Supreme Court's decision in People v. Wells, followed by the United States Supreme Court decision in Navarrette, this type of intermeddling has become quite popular and law enforcement officers have begun to rely upon these types of citizen reportings, thus the signs one sees along the freeways advising drivers to call 911 if they believe they see a DUI Driver.

Regardless, the issue of objective signs of intoxication is what provides officers with probable cause to arrest, which would include a person's performance on the field sobriety tests portion of a DUI Investigation. Obviously without such evidence, the officer's basis upon which he/she determined he/she had probable cause is weakened by the absence of DUI Investigation without the benefit of a field sobriety test evaluation.
